The reach of &quot;commercial use&quot; is a difficult question. There are so many &quot;borderline&quot; situations.

A film-maker approached me about using my song in her film for film festivals. To me, a film festival, absent compensation, is not a particularly commercial use.
But would the other folks I sampled see it the same way? I was not sure, so that went and asked them. Of three artists I asked, 2 responded quickly--&quot;no problem&quot;. But one has not responded yet.
The main trouble with rights clearance, of course, is &quot;non-response&quot;. :)

I wish that CC licenses were very broad on non-commercial.

I am not sure that the &quot;money changes hands&quot; rule always works, but it&#039;s a start in the right direction. I think that perhaps it could be broadened a bit, and then one would have the right thing.

For me, it all reminds me to release BY and not BY NC at least some good portion of the time.</description>
