Very thoughtful post.

The reach of “commercial use” is a difficult question. There are so many “borderline” situations.

A film-maker approached me about using my song in her film for film festivals. To me, a film festival, absent compensation, is not a particularly commercial use.
But would the other folks I sampled see it the same way? I was not sure, so that went and asked them. Of three artists I asked, 2 responded quickly–”no problem”. But one has not responded yet.
The main trouble with rights clearance, of course, is “non-response”. :)

I wish that CC licenses were very broad on non-commercial.

I am not sure that the “money changes hands” rule always works, but it’s a start in the right direction. I think that perhaps it could be broadened a bit, and then one would have the right thing.

For me, it all reminds me to release BY and not BY NC at least some good portion of the time.
